SeaWorld Parks & Entertainment, Inc. and its affiliates operate theme parks and entertainment venues throughout the United States of America (“U.S.”). SeaWorld uses cookies and similar technologies on both our websites and mobile applications.  A cookie is a small text file that is sent by a website, accepted by a web browser, and then placed on your hard drive. We use the information gathered by cookies and similar technologies to improve our products and your experience on our websites by evaluating the use of our website, products and services, to personalize content and ads, to provide social media features and to analyze our traffic.

Remarketing allows us to serve you with an advertisement when you visit other websites after having visited one of our websites.  This means that websites that are not controlled by us, including Google, will show our ads when you visit their websites.  It also means that other advertisers, including Google, will show their advertisements on our Sites.

Custom Audience Targeting

When you sign up for any SeaWorld email marketing or newsletter list, you expressly give us permission to provide your email address to Facebook for use solely in connection with its Custom Audience Targeting program.  Facebook will match your email address to its database and will display advertisements for SeaWorld parks and services on your Facebook portal. Our Commitment to Children’s Privacy

The SeaWorld websites are not intended for use by children under the age of 13 or any children outside the United States. SeaWorld does not market any of its products online for children under the age of 13, nor does SeaWorld design its online applications, advertisements and other features to attract an audience of children under the age of 13.  Although certain pages within the website may reference “kids,” “children,” or “students,” SeaWorld strictly intends for such portions of the website to be used only by adults (such as parents and teachers) or children residing in the United States of the age 13 or older. 

SeaWorld does not share information obtained from minors with other companies for their own use.  The third parties who may have access are those assisting us with, or cosponsoring, our order fulfillments, bookings or registrations, such as for purposes of filling orders, camp registrations or processing payments.  We do not share a child’s information with blogs or other sites where the information would be publicly accessible.  We may collect limited information for a one-time contact.  In such a situation, we do not keep the information, nor disclose it or use it for any other purpose.

If SeaWorld should inadvertently collect information from a child under the age of 13, or from a minor outside of the United States, we delete that information, except to the extent needed to seek verifiable parental consent from the minor’s parent or legal guardian.  When verifiable parental consent is obtained, we collect only that personal information from a minor that is relevant to the registration or purchase.  We protect the information with security safeguards and confidentiality measures that are commensurate with the sensitivity of the information.  Parents or legal guardians have the right to review their child’s personal information, delete it, or withdraw permission to allow further collection or use of that information.

Additional California Privacy Rights

Residents of the state of California have privacy rights afforded them under a variety of state laws, including the California Consumer Privacy Act (CCPA).  The information provided below is designed to address specific aspects of those rights.


“Shine the Light” Law

CCPA Rights Requests

Subject to certain conditions and exemptions, residents of California have the right to:

  • Know the personal information we collect about you, how it is used, disclosed and sold, and
  • Request the personal information we collect or maintain about you be deleted.

Please note that by California law, access and deletion requests do not need to be honored until January 1, 2021 if the request pertains to current or former:

  • Job applicants
  • Employees
  • Owners, Directors and Officers of the organization
  • Independent contractors
  • Medical staff members
  • Emergency contacts (for any of the specific individual above)
  • Beneficiaries (in the context of benefits programs for the specific individuals above)
  • Business-to-business (B2B) contacts

 

In addition, please note that by law we are required to retain your personal information under certain circumstances even if you submit a request for it to be deleted.

If you wish to exercise these rights, you may submit your request one of three ways:

  • By visiting the Guest Services department at any of our California parks.

If you submit a request through the website form, you will receive a confirmation email back from [email protected]

Additionally, you may permit another person or organization (an “authorized agent”) to submit a rights request on your behalf.  If that is the case, your authorized agent may use any of the methods listed above to make a request for you.  We will need to collect information about both the authorized agent and about the person for whom the request is being made, in order to make sure the authorized agent has your permission to make a request on your behalf.

Depending on the type of request, we may need to ask for additional information to verify your identity.  We will only ask for information from you that we already have in our possession in order to confirm who you are.  Additionally, any information we collect in order to verify and satisfy your request will only be used for that purpose.

No one exercising his/her privacy rights will receive discriminatory treatment due to exercising those rights.

If applicable to SeaWorld under the CCPA regulations, beginning January 1, 2021, SeaWorld will publish metrics related to CCPA Rights Requests.

 

California Notice of Right to Opt Out of Sale of Personal Information

 

Under the California Consumer Privacy Act of 2018 (“CCPA”), California residents have a right to opt-out of a “sale” of personal information to third parties. SeaWorld employs various advertising or remarketing tools, technologies and services that serve you targeted advertisements to make your online experience more focused to your interests. Such advertising use may be considered a “sale” of personal information under the broad definition of sale in the CCPA. We do not wish to use your personal information in ways that you don’t approve of, therefore, we have provided multiple tools to make it as easy as possible for you to exercise your right to not have your information used for analytics or advertising.

If you would like to opt out from interest-based advertising, such as the remarketing described above, please use the tools available at the Digital Advertising Alliance (“DAA”) WebChoices page at http://optout.aboutads.info/?c=2 and the Network Advertising Initiative’s opt-out page at http://optout.networkadvertising.org. Please note that when using these ad industry opt-out tools, you may need to execute opt-outs for each browser or device that you use, and that other companies’ opt-outs may function differently than our opt-out.

Additionally, please submit your request to opt out of a “sale” one of three ways:

Managing Your Device-Level Opt-Out Decisions. If you have exercised your right to opt out, you may still need to adjust your browser and device preferences on each of your devices.  Please review the Digital Advertising & Cookies section of our notice for more information.

California Rights and “Authorized Agents”. With your written permission, another person or organization (an “authorized agent”) may submit a rights request on your behalf.  If you make a request through an authorized agent, your authorized agent may use any of the methods listed above.   Your authorized agent must still provide information to verify your identity.  In addition, the CCPA also requires that your authorized agent must provide either proof of power of attorney or some other written permission from you that proves he or she is authorized to submit a request.

 California Notice of Financial Incentives

SeaWorld offers displays of daily discounts on its websites for individuals who provide an email address for marketing purposes.  If an individual does not provide an email address these same daily discounts will still be available. 

If an individual has provided an email address and no longer wishes to receive email communications, they may opt out at any time by clicking on the “Unsubscribe” link found in the emails or newsletter that we send to you or by contacting us by sending an email to [email protected], or write to us at:  PO Box 690129, Orlando, FL 32869, ATTN: Privacy.

Additionally, SeaWorld may on occasion offer discounts, gift cards, sponsor contests and sweepstakes to incent individuals to provide their personal information, which we then use for marketing purposes. These offerings may involve some or all of the following categories of personal information:  Identifiers, Legally-Protected or Sensitive Information, Commercial Information, Sensory Information, or Social Media Postings.   The terms of each of these offerings, as well as the method to opt-in to the incentive, and the right to subsequently opt-out will be provided specific to each offering.
